Terms of Service

These terms govern the use of the ASMO360 VPN service, operated by ASMO LLC, Republic of Armenia.

1. Acceptance

By using ASMO360 you confirm that you have read these terms and accept them. If you do not accept them, stop using the service.

2. The Service

ASMO360 is a VPN service. It routes your internet traffic through an encrypted connection to a server you choose and hides your IP address from the resources you visit.

The service is provided as applications for iOS, macOS and Android and as a personal account on the website.

There is a free plan with limits on traffic and features, and there are paid subscriptions. Current limits and prices are shown in the application.

3. Your Obligations

• give accurate information when creating an account
• use the service only for lawful purposes
• check that the use of a VPN is permitted where you are located
• do not attempt to break into, overload, reverse engineer or bypass the protections of our systems
• keep your account credentials secure and tell us if they are compromised

You are responsible for all actions performed through your connection.

4. Acceptable Use

The service is intended for protecting personal data and communications, encrypting traffic on untrusted networks, and securing remote access to resources.

The service must not be used for:

• activity that breaks the law of the country where the user is located
• unauthorised access, attacks, or interference with any network or system
• distributing malicious software or unsolicited bulk messages
• infringing the rights of third parties

ASMO LLC does not support the use of the service for unlawful purposes. Responsibility for lawful use rests with the user.

5. Payments and Subscriptions

Paid plans are prepaid. The available payment methods depend on the platform and the country and are shown at the moment of purchase.

A subscription renews automatically until it is cancelled. Cancelling stops the next charge; the paid period already started runs to its end.

Purchases made in the iOS and macOS applications are processed by Apple. Purchases made through Telegram are processed by Telegram. For those transactions their rules also apply.

Refunds are governed by the Refund Policy.

6. Using the VPN

• ASMO360 is a privacy and data security tool. It is not offered as a means of bypassing restrictions imposed by state authorities.
• The availability of an individual server is not guaranteed. Servers may be added or withdrawn.
• Speed and traffic may be limited according to your plan.
• We may restrict access where we detect abuse, unlawful use, or a threat to the infrastructure.

Section 11 sets out notices for individual countries.

7. Intellectual Property

The applications, software, infrastructure and brand belong to ASMO LLC. Copying, modifying, distributing or creating derivative works without written permission is not allowed.

8. Liability

The service is provided "as is". We do not guarantee uninterrupted operation, any particular speed, or availability in a given country.

We are not liable for indirect or consequential loss. Our liability is limited to the amount paid for the period affected.

We are not liable for the consequences of a user breaching the law of their jurisdiction, nor for blocking imposed by internet providers or state authorities.

9. Suspension and Termination

We may suspend or close an account for a breach of these terms, for suspected unlawful use, or where the law requires it. You may stop using the service and delete your account at any time.

10. Changes to the Terms

We may amend these terms. The current version is always available in the application and on the website. Continued use after publication means acceptance of the changes.

11. Country Notices

VPN services are regulated differently from country to country. The user is responsible for knowing and following the law of their own jurisdiction. Below is a non-exhaustive summary provided for general guidance; it is not legal advice.

Russian Federation

Under Russian federal law, including Federal Law No. 149-FZ and its amendments, using software to reach resources blocked by Roskomnadzor may carry administrative liability. Since March 2024 it is also prohibited to advertise or distribute information about means of bypassing blocks. ASMO360 is a tool for privacy and data security, not for bypassing restrictions imposed by state authorities. Users in Russia must use ASMO360 strictly within applicable law.

People's Republic of China

Under the law of the PRC, including the Cybersecurity Law (2017) and MIIT regulations, only VPN services approved by the authorities may be used in mainland China. ASMO360 holds no licence from the telecommunications authorities of the PRC and is not approved for use as a cross-border data channel. Users in mainland China must comply with all applicable national and local regulations.

Islamic Republic of Iran

Under Iranian law, including the Computer Crimes Law (2009), the use of unauthorised VPN services is restricted. ASMO360 is not intended for bypassing content restrictions imposed by the Iranian authorities. Users in Iran must comply with applicable law.

United Arab Emirates

The use of VPN services in the UAE is regulated by the TDRA and Federal Decree-Law No. 34 of 2021. Use for lawful purposes, such as protecting data and securing communications, is permitted. Using a VPN to commit or conceal a crime, to reach prohibited content, or to use unauthorised communication services may lead to fines from AED 500,000 to AED 2,000,000 and to imprisonment. Users in the UAE must use ASMO360 only for lawful purposes.

Kingdom of Saudi Arabia

The use of VPN services in Saudi Arabia is subject to the rules of the Communications, Space and Technology Commission (CST). Use for lawful business purposes and for personal privacy is permitted. Using a VPN to reach content prohibited under Saudi law may carry legal consequences. Users in Saudi Arabia must comply with local regulations.

12. Governing Law

These terms are governed by the law of the Republic of Armenia. Disputes are resolved by the competent courts of Yerevan. Users in other countries must also comply with their own law.
